1. Eligibility & Use of the Service

• 1.1 You must be at least 18 years old or the age of majority in your jurisdiction to use Averiqx.
• 1.2 By using the Service, you represent and warrant that you meet all eligibility requirements and have the legal capacity to enter into these Terms.
• 1.3 Averiqx is not intended for clinical, therapeutic, medical, or psychological diagnosis. All results, insights, and evaluations are informational only and do not constitute professional advice.

2. Nature of the Service

• 2.1 Averiqx provides an interactive AI conversation system that conducts cognitive analysis based on communication patterns, language features, reasoning behaviors, and other observable conversational attributes.
• 2.2 The Service uses machine-learning models and proprietary algorithms ("Averiqx Cognitive Modeling Engine") to generate:
  • Conversational IQ estimates
  • Cognitive dimension estimates
  • Behavioral summaries
  • Personalized insights
  These outputs may vary based on context, input quality, and model behavior.
• 2.3 Averiqx does not claim scientific verification equivalent to standardized clinical assessments such as the WAIS-IV, WISC, Stanford-Binet, or any other formal psychological instrument.
• 2.4 Any references to academic or cognitive frameworks are incorporated purely as influence, alignment, or structural inspiration, not as strict equivalence.

3. Accounts & User Responsibilities

• 3.1 Users may be required to create an account to access certain features.
• 3.2 You agree to provide accurate, complete, and up-to-date information.
• 3.3 You are responsible for maintaining the confidentiality of your account credentials.
• 3.4 You agree not to share your account or allow others to access it.
• 3.5 You are responsible for all activity that occurs under your account, whether authorized or not.

4. Paid Services, Billing, and Subscriptions

• 4.1 Averiqx may offer paid features, subscription plans, one-time purchases, or premium cognitive evaluations.
• 4.2 By purchasing a paid Service, you authorize Averiqx to charge your selected payment method at the listed price, including applicable taxes.
• 4.3 Subscription Services renew automatically unless canceled in advance.
• 4.4 Renewal charges will be applied at the beginning of each billing cycle.
• 4.5 Prices may change; you will be notified when required by law or platform policy.

5. Trial Periods and Promotional Offers

• 5.1 Averiqx may offer free trials or promotional access for a limited time.
• 5.2 At the end of a trial, unless canceled, your subscription may automatically convert into a paid plan.
• 5.3 Promotional offers cannot be combined unless explicitly stated.

6. Cancellation & Refund Policy

• 6.1 Users may cancel subscriptions at any time via their account dashboard or by contacting support.
• 6.2 Cancelling stops future billing but does not retroactively refund past charges.
• 6.3 Refund Window: Averiqx may, at its discretion, provide refunds within 14 days of the original purchase only if the user has not substantially consumed or completed the primary Service (e.g., final cognitive report generation).
• 6.4 Refunds are generally not available if:
  • You completed a full conversational assessment
  • You accessed a personalized report
  • The billing cycle has already renewed
  • The request is made beyond the refund window
  • The account shows unusual or abusive usage patterns
• 6.5 Chargebacks filed through banks or card issuers may lead to immediate account suspension and forfeiture of access to all reports.

7. Content & Intellectual Property

• 7.1 All content, branding, algorithms, text, graphics, icons, reports, and software belong to Averiqx and are protected by copyright and other intellectual property laws.
• 7.2 Users may not copy, reverse engineer, distribute, or commercially exploit any part of the Service.
• 7.3 Averiqx grants you a limited, non-exclusive, revocable license to use the Service for personal, non-commercial purposes.

8. User-Generated Content

• 8.1 During use, you may provide text, messages, or other input ("User Content").
• 8.2 You retain ownership of your User Content but grant Averiqx a global, royalty-free license to store, process, analyze, and improve the Service.
• 8.3 Averiqx may use anonymized, aggregated data to enhance model performance.

9. Prohibited Conduct

Users may not:

• Interfere with or attempt to bypass security measures
• Use automated scripts or scraping tools
• Attempt to probe, train, or reverse engineer the AI systems
• Submit harmful, illegal, abusive, or exploitative content
• Harass, impersonate, or misrepresent identity
• Use the Service for clinical, diagnostic, or therapeutic purposes

Violation may result in account suspension or legal action.

10. Privacy & Data Handling

• 10.1 Averiqx collects certain data for the purpose of providing and improving the Service.
• 10.2 Data may include:
  • Chat transcripts
  • Cognitive report outputs
  • Technical and analytical data
  • Session events or usage logs
• 10.3 We implement reasonable safeguards to protect user data, but no system is entirely free of risk.
• 10.4 Users acknowledge that anonymized data may be used to improve AI models and research internal to the platform.

11. AI Limitations & Disclaimer

• 11.1 The Service relies on probabilistic models and may produce inaccurate, incomplete, or unexpected outputs.
• 11.2 The cognitive estimates provided are interpretive, not clinical, diagnostic, or professional evaluations.
• 11.3 Averiqx makes no guarantees regarding accuracy, reliability, or scientific validity of results.
• 11.4 Users should not make significant decisions (medical, financial, psychological) based on AI-generated content.

12. Service Availability & Modification

• 12.1 Averiqx may update, modify, suspend, or discontinue the Service at any time.
• 12.2 Scheduled and unscheduled downtime may occur.
• 12.3 Averiqx will not be liable for loss of data or interruption of access.

13. Limitation of Liability

To the fullest extent permitted by law:

• 13.1 Averiqx is not liable for any indirect, incidental, consequential, punitive, or special damages.
• 13.2 Our total liability for any claim shall not exceed the amount paid by the user in the last 12 months.
• 13.3 Users acknowledge that AI-generated results may contain errors and accept all responsibility for how they use them.

14. Indemnification

You agree to indemnify and hold harmless Averiqx from any claims resulting from:

• Your misuse of the Service
• Violation of Terms
• Infringement of rights
• Legal disputes arising from your content or actions

15. Governing Law & Dispute Resolution

• 15.1 These Terms are governed by the laws of Singapore (or your chosen jurisdiction).
• 15.2 All disputes shall be resolved through binding arbitration, not court litigation.
• 15.3 Users waive the right to participate in class actions.

16. Changes to Terms

Averiqx may update these Terms periodically. Continued use of the Service constitutes acceptance of updated Terms.
